H&R Block Client Wi-Fi Terms and Conditions
In order to use the H&R Block wireless internet access (“H&R Block Client Wi-Fi”), you must agree to these H&R Block Client Wi-Fi Terms and Conditions, which is a contract between you and HRB Tax Group, Inc. (“us,” “we,” or “our”). If you are under 13 or not a client of H&R Block, you may not access the H&R Block Client Wi-Fi.
- Privacy Practices
1.1 - Your use of the H&R Block Client Wi-Fi is governed by our privacy practices as set forth in H&R Block Privacy Notice. This notice may be updated by us from time to time, so please check back frequently. 1.2 - We may keep a log of IP addresses accessing the H&R Block Client Wi-Fi and the related activity. 1.3 - We may disclose information to proper federal, state, or local officials in order, and to the extent necessary, to inform the official of activities that may constitute a violation of criminal law or to assist in investigating or prosecuting a violation of criminal law.
- Your Use of the H&R Block Client Wi-Fi
2.1 - Use at Your Own Risk. We do not recommend the use of any websites or other internet related services and your use of the H&R Block Client Wi-Fi is carried out entirely at your own risk. We have no responsibility for or control over the information you transmit or receive. 2.2 - No Security. We do not guarantee the security of any information you transmit or receive. We recommend that you do not use the H&R Block Client Wi-Fi to transmit or receive any confidential information. You are responsible for protecting your information. 2.3 - No Warranties. The H&R Block Client Wi-Fi is provided solely as a convenience to you, "as is," with any and all faults or defects. We disclaim all warranties and representations of any kind, whether express, implied or statutory, including without limitation any warranties: a. regarding the availability, speed, or compatibility of the H&R Block Client Wi-Fi b. of merchantability, fitness for a particular purpose, non-infringement, workmanlike effort, quality, accuracy, timeliness, completeness, title, quiet enjoyment, no encumbrances, no liens, or system integration; or c. that access to or use of the H&R Block Client Wi-Fi or any part thereof will be uninterrupted, error or defect free, free of viruses or other harmful elements or features, or secure, or that problems will be corrected, even if we are on notice of such problems. 2.4 - Limitation of Liability. The H&R Block Client Wi-Fi does not impose liability of any kind or in any amount on us including without limitation, liability for any direct, indirect, special, consequential, incidental, punitive or exemplary damages (including, without limitation, lost profits, loss of business, business interruption, loss of data, or other similar damages) arising out of or related to these terms and conditions or the H&R Block Client Wi-Fi, even if we are advised of the possibility of any such damages. You specifically waive any and all claims against us related in any manner to your use of the H&R Block Client Wi-Fi. If for any reason any of the foregoing limitations of liability or waiver are determined to be unenforceable, then our maximum aggregate, cumulative liability, arising out of or related to these terms and conditions, shall not exceed your direct damages, if any, up to fifty dollars ($50). You agree that the limitations and waivers in this section shall be deemed to apply to all causes of action. 2.5 - Termination of service. We may, at any time and for any reason, change, terminate, limit or suspend the H&R Block Client Wi-Fi or your access to the H&R Block Client Wi-Fi. 2.6 - Prohibited Uses. You must not use the H&R Block Client Wi-Fi to access websites, send or receive e-mails, or otherwise participate in actions which: a. disseminate libelous, harmful, vulgar, pornographic, obscene or otherwise objectionable material; b. contain nudity, violence of offensive subject matter, or are deemed exploitive in any way; c. promote racism, prejudice, bigotry, hatred, harassment or physical harm of any kind against any individual, group or individual; d. promote illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous; e. promote any criminal activity or enterprise or provide instructional information about illegal activities, such as making or buying illegal weapons or violating someone's privacy; f. use information that infringes any patent, trademark, trade secret, copyright or other rights of any party; g. transmit any material that contains software viruses, trojan horses, worms, time bombs, cancelbots, or any other computer code, files, or programs which may interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; h. impersonate anyone or any entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity; or i. interfere with or disrupt the H&R Block Client Wi-Fi.
- Other Terms
3.1 - Updates to these Terms and Conditions. We may update or revise these terms and conditions at any time without prior notice. Your continued use of the H&R Block Client Wi-Fi following an update to these terms and conditions signifies your acceptance of any revised terms. 3.2 - Governing Law. These terms and conditions will be governed by the laws of the State of Missouri, without regard to conflicts of law provisions. Any legal action or proceeding between you and us related to this Agreement will be brought exclusively in a federal or state court of competent jurisdiction in Jackson County Missouri. 3.3 - Arbitration. The Arbitration Agreement titled “ARBITRATION IF A DISPUTE ARISES” in the document titled “CLIENT SERVICE AGREEMENT TAX SEASON 2015—TAX YEAR 2014” is incorporated herein by reference. You agree that your use of the H&R Block Client Wi-Fi is within the scope of this Arbitration Agreement. You may reject the Arbitration Agreement by following the procedure described in the Client Service Agreement.
